With these notes on data protection, we would like to inform you when we store which data and for what purpose we use it – of course, in compliance with the applicable data protection regulations.

Basic information

Unless otherwise stated in the following sections, no personal data is collected, processed or used by visiting and using our websites.

When you access our web pages, our web servers automatically collect information of a general nature.
This includes the type of web browser, the used operating system, the domain name of the Internet service provider, the IP address of the computer, the website from which you visit us, the pages you visit, the date and duration of the visit from our homepage.
We cannot use this information to identify the individual user.
This information only got analyzed statistically by us and get used exclusively to improve the attractiveness, content and functionality of our websites.

Concept of personal data

The concept of personal data is defined in the Federal Data Protection Act.
Thereafter, these are individual details about personal or material circumstances of a specific or identifiable natural person. This includes, for example, your civil name, your address, your telephone number or your date of birth.

In the EU General Data Protection Regulation (EU GDPR), which will enter into force on 25 May 2018, personal data are defined as follows:
Any information relating to an identified or identifiable natural person (hereinafter the “data subject”); a natural person is regarded as identifiable, which can be identified directly or indirectly, in particular by association with an identifier such as a name, an identification number, location data, an online identifier or one or more special features, the expression of the physical , physiological, genetic, mental, economic, cultural or social identity of this natural person.

Legal basis

Insofar as we obtain your consent for processing of personal data, Art. 6 para. 1 lit. a EU GDPR ist the legal basis for the processing of your personal data.

When processing your personal data in order to fulfill a contract between you and KORN CONSULT GmbH, Art. 6 para. 1 lit. b EU GDPR is the legal basis. This also applies in case for processing operations by pre-contractual actions.
Insofar as processing of personal data is required to fulfill a legal obligation that is subject to our company, Art. 6 para. 1 lit. c EU GDPR is the legal basis.

If processing is necessary to safeguard the legitimate interests of our company or a third party, and if the interests, fundamental rights and freedoms of the data subject do not prevail over the first interest, Art. 6 para. 1 lit. f EU GDPR is the legal basis for processing.

The data collection, processing and use of applicant data for the implementation of the application process is in the legitimate interest of KORN CONSULT GmbH in accordance with article para. 1 lit. f EU GDPR.

The interests, fundamental rights and fundamental freedoms of the applicants do not outweigh the former interest.

The same applies to the transfer of your data to the KORN CONSULT GROUP for the purpose of answering and forwarding inquiries.

Data erasure and storage duration

The personal data of the data subject will be deleted or blocked as soon as the purpose of the storage is eliminated.
In addition, the data can be stored if the European or national legislator requires that in EU regulations, laws or other regulations to which the responsible person is subject.

Blocking or deletion of the data also takes place when a storage period prescribed by the standards mentioned expires, unless there is a need for further storage of the data for conclusion of a contract or fulfillment of the contract.

Collection and processing of personal data

Personal data is only collected if you provide it yourself, for example to carry out an order, a survey, or a registration for personalized services.
Then you will be informed about the intended processing purpose and, if necessary, your consent for the storage.

The personal data which get collected without your consent in the context of our web pages are used only for the order processing or processing of your inquiries and if necessary passed on to the responsible department.

In addition, your data will only be used in a centrally managed customer and prospect database managed by KORN CONSULT GROUP but with your consent.

Our employees, agencies and distributors are bound by us to strictest confidentiality.

Contact

You have the possibility to contact us at our e-mail address or our contact form. We will exclusively use the personal data transmitted via this way to that purpose that have been made available to us.
In case we ask for input in our contact form that isn’t necessary for contacting, we marked this field as optional. This data serves to concretize your inquiry and for a better processing of your request. A notice of this data is explicitly on a voluntary basis and with your consent. If it deals with data for communication channels (for instance e-mail address, phone number), you agree that we can contact you via this communication channel to answer your request.

Certainly, you can revoke this consent at any time in the future. Please contact hereto our data protection officer whose contact details can be found below.

Application

You can apply to us via e-mail and by post. Your application will be directly forwarded to our Human Resources Department and will be treated as confidential. We will use your data of course exclusively for processing your application and will not forward it to third parties outside the KORN CONSULT GROUP.

If you applied for a specific job position and it is no longer vacant and we see you as capable to or fit even better for another job position, we would like to forward your application within our company. Please let us know if you do not agree to this forwarding. Your transmitted personal data will be deleted after the completion of the application procedure or maximum after six months in case you have not explicitly agreed to a longer filing of your data.

If you are sending your application documents via e-mail, we expressly point out that e-mail attachments are not encoded.

Contacting via telephone

If we contact you for the first time via telephone, we used the data from public sources. Our interest in the processing of the first contacting via telephone overweighs the interest of the person because we approach only B2B-clients via contact channels from public sources and the contacting refers to concrete processes in connection with the business activity of the person concerned. We only ask about the initial telephone contact if there is an interest in contact and do not already point to our services.

Data transmission to other affiliated companies

A transfer of your data to third parties outside the KORN CONSULT GROUP will not take place, unless we are legally obliged to do so, or the data transfer is necessary for the execution of the contractual relationship or you have previously expressly consented to the disclosure of your data. External service providers and partner companies will only receive your data if this is necessary to process their request. In these cases, however, the amount of data transmitted is limited to the minimum required. As far as our service providers come into contact with your personal data, we ensure that they comply with the provisions of data protection laws in the same way. Please also note the respective privacy policy of the provider. The content of external services is the responsibility of the respective service provider, where reasonably practicable, we check the services for compliance with legal requirements.

Data transmission to external service providers (processor)

Your data will be passed on to service partners, if they work on our behalf and support KORN CONSULT GROUP in the provision of its services.

A processing of your personal data by commissioned service providers takes place in the context of order processing acc. Art. 28 GDPR.

The aforementioned service providers only receive access to such personal information as is required to perform the respective activity. It is forbidden to these service providers to pass on your personal information or to use it for other purposes, in particular for own advertising purposes.

As far as external service providers come into contact with your personal data, we have ensured through legal, technical and organizational measures as well as through regular controls, that they comply as well with the applicable data protection regulations.

There is no commercial disclosure of your personal information to other companies.

Website Optimization Tools

As part of the collection of personal data via website optimization tools, we rely on our legitimate interest acc. Art. Sec. 1 lit. f GDPR in conjunction with recital no. 47. Thereafter, direct mail is usually a legitimate interest. Their interests, fundamental rights and fundamental freedoms do not outweigh our interest in advertising, since we inform you comprehensively about the data collection in the context of our privacy policy and you always have the option of opting out (via link or browser settings). In addition, we only use pseudonymous tracking.

Rights of the persons concerned

  • Right of access to personal data due to article 15 EU GDPR
    You may request a confirmation if your personal data are processed by us. If we have processed your personal data, you have additional rights of access mentioned in article 15 EU GDPR.
  • Right of rectification of personal data
    If your personal data, which we have collected, are incorrect or incomplete, you can demand immediate correction pursuant to article 16 EU GDPR.
  • Right of limitation of processing
    Under the conditions of Article 18 of the EU GDPR, you may also be required to restrict the processing of your personal data.
